No Insurance Special Reasons Argument Successful

Having negotiated a plea to driving without insurance whereby one of our clients' plea of not guilty was accepted, we successfully argued that in respect of the other client special reasons existed not to endorse her licence for allegedly 'causing and permitting'. The Court agreed that it was the insurance company that was to blame for the lack of insurance and not our client. In ordinary course we would have required to present the evidence at a dedicated Special Reasons Proof but owing to our persuasive powers both the Crown and the Court agreed to simply allow legal submissions to be made in respect of our client. The success of those submissions ensured that both of our clients avoided any penalty points being added to their driving licences.
