153mph Client Avoids Prison

Our client was charged with dangerous driving contrary to section 2 of the Road Traffic Act 1988.

He was accused of travelling at 153mph (or 2.6 miles per minute) on the A9 where the speed limit was 70mph. The speed was detected by a laser device. He was recommended to contact our Inverness Office by a serving Police Officer.

The main aim of this case was to avoid a term of imprisonment, thereafter to try to avoid a community payback order and finally to restrict the period of disqualification.

We achieved all of the above. The Procurator Fiscal was prepared to accept that any device is fallible and accordingly we were able to persuade the Fiscal to reduce the speed to 143mph in exchange for a guilty plea.

The case called on 28th March 2019 where it was deferred for reports.

At the hearing on 25th April 2019 our Mr Simpson successfully addressed the Court in mitigation. Our client was handed a £6,000 fine and disqualified for 2 years.

To the best of our knowledge, this is the fastest recorded speed in the UK where the driver has avoided a custodial sentence.

Dangerous Driving By Overtaking At 115mph On The A75

Our client was facing a minimum disqualification of 1 year along with an order to resit an extended driving test. We managed to persuade the Procurator Fiscal that the standard of driving was careless as opposed to dangerous (depsite being clocked at 115mph in a 60mph limit and overtaking vehicles in contravention of solid white lines). Our client was disqualified for only 6 months and a relatively modest fine of £450 was imposed....
