Dangerous Driving Car Crash Careless Driving Accepted

Our client contacted us having collided with a railing and thereafter driven along the road into on-coming traffic and colliding with another car causing damage to both vehicles. Our client's position was that his vehicle had suffered mechanical failure leading to a loss of steering control. The vehicle had been scrapped shortly after this incident so no mechanical examination was possible.

This was an unusual case and was complicated by the presence of another charge that could have caused significant problems had the matter proceeded to Trial.

We do not advise clients to take cases to trial unless there are reasonable grounds for success. To do otherwise would be folly and a burden borne by you, the client. 

We discussed the case with the Procurator Fiscal and with some hesitation they were persuaded to accept that the standard of driving was careless as opposed to dangerous.

We appeared on behalf of our client and spent an hour mitigating on his behalf. The Sheriff imposed 6 penalty points and a fine of £400. 

This case was dealt with by our Mr Simpson at Livingston Sheriff Court on 6th August 2020.
