Dunoon Sheriff Court Drink Driving Offence

Our client was on a weekend break to Dunoon and having had an evening meal with a glass of wine was heading back to her hotel when she took a wrong turn and entered a one-way street in the wrong direction. 

As is unfortunately almost always the case, the Police were there and when they spoke with her they detected a smell of alcohol on her breath.

She was breathalysed at the roadside and failed the test. She was arrested and provided readings back at the police station which were over the prescribed limit.

She was released on an undertaking to attend at Dunoon Sheriff Court for a charge of drink-driving contrary to the Road Traffic Act 1988, Section 5(1)(a)

She contacted our office for advice and we advised that the appropriate plea was one of guilty.

Our Mr Simpson attended at Dunoon Sheriff Court on 2nd May 2019 and delivered a plea in mitigation which resulted in the Court disqualifying for the minimum period of 12 months and imposing a fine of £250. The Sheriff was also persuaded that the client should be commended for the Drink-Drive Rehabilitation Scheme which upon completion would reduce the ban to 9 months which is the lowest ban possible in a drink-driving case.
