Penalty Points Dumfries Dangerous Driving

This matter concluded in Dumfries Sheriff Court on 8 February 2022. Our client had originally been charged with dangerous driving by overtaking an articulated motor lorry when it was unsafe to do so and, unfortunately for our client, in the face of an oncoming Police vehicle which had to take fairly drastic evasive action to avoid a collision. The accused conceded the matter could have been much worse had it not been for the skills of the Police driver.

We were able to highlight a number of mitigating factors in relation to the offence itself which persuaded the Crown to downgrade the matter to careless driving. The case wasn’t quite over the line at that point as our client had six live points on his licence at the time. Having heard mitigation, the presiding Sheriff was persuaded to restrict the endorsement to five penalty points which allowed our client to continue driving, albeit on a knife edge of 11 points.
