Dangerous Driving Negotiated To Speeding

Our client was one of three drivers involved in an allegation of dangerous driving. The allegation was that they had been racing, swerving across the roadway and generally behaving in a manner that caused other road users to take evasive action.

In our opinion, the conduct complained of was not as bad as was being alleged. 

We spent almost 2 years in negotiations with the Procurator Fiscal's Office. Our client was a new driver and during the time it took for the case to come before the Court, he had had his licence endorsed with 3 penalty points for a separate matter. 

Eventually, we persuaded the Crown to take a plea to speeding. Sentencing options were restricted owing to the new drivers' provisions. If our client got any points his licence would have been revoked and he would have been forced to resit his test. As an alternative, our Mr Simpson was able to persuade the Court to impose a short-term ban of 30 days. This allowed our client to forgo the requirement to resit his test. He was also fined £375.

A very good result indeed.
