Special Reasons Edinburgh Upheld

Our client's father had advised him that he was fine to drive his car and that he was covered by a policy of insurance. Unbeknownst to him, the cherished plate on the vehicle had not been intimated to the insurer who - somewhat unfairly - declined cover on that basis notwithstanding that no accident or reportable incident had occurred.

Following upon his plea of guilty, our intervention allowed the case to be dealt with by legal submissions (as opposed to a full proof) which were upheld by the Court.

Our client was given an 'Absolute Discharge'. He received no points and no fine.
