107mph Speeding Charge Dumfries No Ban

This case was heard in Dumfries Justice of the Peace Court on 16 October 2018. Our client had been charged with speeding at 107mph on the A74(M) Glasgow – Carlisle road. This was a static speed check using a LTI 20.20 Ultralyte speed measuring device. Whilst the road conditions at the time were positive, the speed attained certainly placed our client squarely within disqualification territory.

Our client instructed a plea of guilty at the earliest opportunity. As the court is entitled to take into account the stage at which a plea is tendered and discount the sentence having regard to the utilitarian benefit of the timing of the plea, it can often be a wise decision for an accused to enter a plea of guilty at the earliest possible opportunity.

The mitigation in this case was fairly persuasive as our client relied heavily upon his driving licence to look after his younger brother who was registered disabled. The court carefully considered the submissions and was persuaded, only just it has to be said, to impose six penalty points rather than a period of disqualification.
