For offences committed after 1 March 2017, the endorsement has been doubled to six penalty
points. Mobile phone usage whilst driving remains one of the most frequently prosecuted road
traffic offences in the lower courts. A new driver is liable to face revocation if caught using the
phone only once. The question of whether a driver is actually using a mobile telephone whilst driving
will be a perennial issue for Scottish courts.
