Airdrie Sheriff Court Dangerous Driving Charge Minimum Penalty

Reduced Sentence
Airdrie Sheriff Court

Our client was accused of travelling at 83mph in a 40mph limit on the A73 and charged with dangerous driving. We looked at every aspect of the evidence in order to try and find a way out of the charge or a way to lessen the impact it would have upon our client's driving entitlement.

The case was delayed due to the coronavirus pandemic and we entered into lengthy discussions with the Crown. The issue in the case was that the speed was very high compared to the limit. It was also said to have occurred at around 3pm.

The Procurator Fiscal could not be persuaded to reduce the charge to careless driving. We were able to control the narrative though and the gently, gently, approach that we had insisted upon was provided to the Court.

The case was dealt with at Airdrie Sheriff Court on 20th August 2020 and with the limited narration given by the Crown and strong mitigation the Sheriff was persuaded to limit the period of disqualification to the statutory minimum of 12 months. Our client was also fined £300.

This was a very good result in the particular circumstances of the case.
