The Crown is entitled to rely upon the analysis of an accused’s blood specimen in support of a prosecution for drink driving. The forensic analysis in this case registered a reading of not less than 167 milligrammes of alcohol in 100 millilitres of blood. The Crown failed to prepare the case properly and, following an unsuccessful attempt to adjourn, the matter was deserted simpliciter by the court. This meant the Crown was precluded from raising further proceedings and our client was free to leave the dock with his driving licence intact.
