This matter called for trial in Forfar Justice of the Peace Court on 8 January 2020. Our client was subject to totting-up due to the accumulation of previous penalty points and we were instructed to plead not guilty with a view to putting the Crown to the test. The case involved SPECS3, the average speed camera system on the A90, Dundee to Aberdeen road. Having reviewed the evidence in the case we were able to identify a major problem with the evidence, in particular in relation to the site itself, which left the Crown with little option other than to desert the case. The point relied upon by the accused was something we have never come across before and it was only noticed as a consequence of our detailed case preparation strategies. What was the point? We are obviously not at liberty to say as our interest lies with looking after all current and future clients of the firm who may be able to avail themselves of this particular technical defence.
