Our client was accused of causing and permitting another worker to use a motor van without there being a valid policy of insurance in place and without an MOT. It was something that our client vehemently denied and was anxious to retain his driving licence. Causing and permitting charges carry the same penalty as driving without insurance i.e. 6-8 penalty points or discretionary disqualification, and therefore require to be treated seriously.

The evidence was disclosed to our office and we advised our client to maintain his previously tendered plea of not guilty. We had identified a number of evidential difficulties for the Crown, hurdles over which we suspected that they would not be able to jump in the context of a trial. 

At the trial the Procurator Fiscal was unable to prove beyond reasonable doubt that our client had caused or permitted the other accused to use the vehicle in question and accordingly he was acquitted by the Court.
