Dangerous Driving Charge Dropped 7 Points

Our client was accused of dangerous driving contrary to the Road Traffic Act 1988, Section 2 (as amended). 

The basic outline of events was that our client was stuck in slow moving traffic close to Byres Road and pedestrians were walking in front of her vehicle constantly.

One of the pedestrians was pregnant and felt that our client's vehicle got too close to her and her boyfriend started remonstrating with the driver.

A friend of the couple then joined in, angrily striking the bonnet causing our client's foot to slip from the clutch and lightly touch the lower leg of the pedestrian who was uninjured.

A charge of dangerous driving followed when really it ought to have been the pedestrians prosecuted for 'really annoying walking'.

Anyway, our Mr Simpson arrived for the trial and managed to persuade the Crown that the driving - if criminal at all - was careless as opposed to dangerous. A plea was agreed and our client received 7 penalty points (around 3-4 too many in our opinion) and a fine of £500.
