Drivers can often get caught up in personal vendettas when driving and a minor infraction can grow arms and legs. Our client was charged driving too close to a preceding vehicle, making offensive hand gestures by sticking up two fingers, swerving in front of the vehicle and then deliberately slamming on the brakes thereby inducing a collision. The case was made more difficult by the presence of an independent witness who observed the latter portion of the episode. With some careful cross examination we were able to cast doubt on the more serious aspects of the case and our client was acquitted of dangerous driving. He was, quite properly in our view, convicted of careless driving and received a mid-range six penalty point endorsement at Kilmarnock Sheriff Court.
