Our client was charged with travelling at more than double the speed limit on the M77 for a distance of 3 miles. He had only been driving for 6 months and his licence was essential to his employment. We used our professional standing to eventually persuade the Procurator Fiscal that the standard of driving was merely careless. After protracted negotiations, the Crown accepted that the allegation of driving at speeds of 110mph in a 50mph was careless rather than dangerous. We thereafter persuaded the Court that our client's licence should only be endorsed with 5 penalty points in order to allow him to continue driving. The Sheriff agreed with our submissions and our client was allowed to drive away from the Court with his licence in tact. This was a result that demonstrates that the reputation and knowledge of your lawyer can make the difference between an almost certain 12 month minimum disqualification and retaining your licence.
