Our client was accused of dangerous driving due to an overtaking manoeuvre captured on police dash-cam. The footage eventually made its way to our office having been delayed for several months due to the pandemic.

Upon receipt of the footage, it was immediately apparent that the driving could not properly be characterised as dangerous and would more properly be described as careless

Our Mr Simpson attended for Trial at Airdrie Sheriff Court on 2nd February 2022 and persuaded the Sheriff that the driving was not so out of the ordinary that the driver required to be 'made an example of'. The Sheriff concurred, and our client's licence was endorsed with 4 penalty points, and he was fined £340.

An outstanding result where the original charge carried a mandatory ban and compulsory extended test.
