Our client was found by Police officers within her vehicle following an anonymous tip-off that she had was over the prescribed alcohol limit. She was indeed over the limit and blew a rather whopping 132 microgrammes of alcohol in 100 millilitres of breath – precisely 6 times the current limit. We were instructed to present the statutory defence that there was no likelihood of the vehicle being driven whilst she was remained over the limit. Having led the necessary toxicological evidence our client was found not guilty at Hamilton Sheriff Court.
