Falkirk Drunk-In-Charge Not Guilty After Trial

This matter proceeded to trial at Falkirk Sheriff Court on 27 September 2021 with our Mr Lyon in attendance and involved an allegation that our client was in charge of a motor vehicle, on New Year’s Day, whilst having an excess of alcohol in his system.

Much of the evidence was dealt with by Joint Minute which shows the benefits of cooperation between the Crown and defence by allowing a focus to be drawn on what is actually in dispute.

Our client was found not guilty after trial, the Sheriff accepting that the statutory defence contained within s.5(2) of the Road Traffic Act 1988 had been made out by the accused on the balance of probabilities.

Our client is a professional driver so the verdict saved his employment.
