The law imposes certain duties on a driver in the event of an accident. Following a bump in a car park the Police charged our client with failing to report the incident at a police station or to a constable as soon as reasonably practicable and, in any case, within 24 hours of the occurrence. The range of penalty for this particular charge is 5-10 points however the courts routinely impose periods of disqualification due to the fact the charge often involves an individual trying to avoid responsibility for a collision, leaving the blameless third party to pay for the damage. Following 18 months of court diets we persuaded the Crown that it was not in the public interest to prosecute the matter and the case was deserted.
