The charge in this case was lengthy and the libel detailed that our client:

  • executed overtaking manoeuvres on sections of the carriageway of the A828 where forward visibility was restricted amd when it was not safe to do so;
  • on the approach to a bend in the carriageway, execute an overtaking manoeuvre when it was unsafe to do so thereby causing a collision with an oncoming vehicle.

The case proceeded to trial and our client was found guilty of the lesser charge of careless driving, contrary to s.3 of the Road Traffic Act 1988 and the matter was disposed of by a penalty point endorsement.
