The locus of this incident was the A72 Blyth Bridge to Peebles Road and our client was alleged to have performed a dangerous overtaking manoeuvre through a blind bend and on the approach to a blind corner. A locus inspection revealed that overtaking at that particular spot was perhaps not as perilous as suggested by the Police in their witness statements. Our client was happy to accept that his driving was careless and elected to plead guilty to the lesser charge of careless driving; a plea which was accepted by the prosecutor. Six points were duly imposed on our client’s driving licence which is a significant improvement over the original penalty which he had faced of at least 12 months off the road.
