Our client faced a serious charge of dangerous driving in Lanark whereby the Crown sought to allege that two overtaking manoeuvres performed on the A70 Ayr Road breached the statutory test for dangerous driving.

This was another case where the complaint had arisen from a civilian witness with a dashcam. The footage had been submitted to the Crown as part of the evidence in the case and our client received court papers citing him to attend Lanark Sheriff Court. Certain procedures require to be followed for cases of this nature and we identified a failure on the part of the Police which proved fatal to the prosecution.

As a consequence, the dangerous driving allegation was deserted by the Crown.
