Twice The Limit Half The Sentence

A client caught driving whilst twice the prescribed breath alcohol limit.  The Court can often take a dim view of such offences, especially with the schedule of previous convictions this individual had.  However, he had been caught 'the morning after the night before' and the offence was borne more of a genuine error rather than anything nefarious on his part. 

In the circumstances, the Sheriff was persuaded to impose the minimum disqualification prescribed by law, namely 12 months.

A lesson learned.
