VASCAR Speeding Perth JP Court

Kept Licence
Perth Sheriff Court and Justice of the Peace Court

Our client worked all over the UK as a sale representative and overtook an unmarked police car on the M90 near Perth.

The police utilised their VASCAR system and detected his speed at 101mph in a 70mph limit. This was problematic as our client was already on 6 penalty points for speeding. His instructions from the outset were simple: 'Keep my licence'.

We were instructed and requested all disclosure in the case. Due to various issues with the Crown's preparation the case acquired a somewhat convoluted procedural history. The case eventually called for Trial on 21st May 2019 after a few false starts. On the morning of the Trial the Procurator Fiscal Depute was kind enough to advise that due to pressure of business there was little prospect of the case proceeding.

We entered into discussions with the Crown and managed to have the speed reduced to 90mph. This was to prove crucial in addressing the Court in mitigation.

Our Mr Simpson dealt with this case at Perth Justice of the Peace Court on 21st May 2019. Our client's licence was endorsed with 4 penalty points and he was fined £360.

There was no risk to our client's licence and was defended solely on a point of principle....
