The Road Traffic Offenders Act permits a person disqualified from driving to apply to the court to seek the early recall of the ban, subject to certain time limits. In this particular case, our client had been disqualified for a period of four years following conviction for a second drink drive offence within a ten year period.

Without rehearsing the merits of the application, we were able to present a petition to the court setting out the reasons why our client should have his driving licence returned early. These reasons were accepted and the petition was granted as craved on 7 April 2022 at Forfar Sheriff Court. The key to this type of case is to ensure the best possible petition is lodged with the court, together with appropriate vouching wherever possible.
