The law imposes various obligations upon a driver, one of which is to comply with notices sent under s.172 of the Road Traffic Act 1988. Our client accepted he failed to provide the required information however the case was deserted by the Crown following representations made in connection with the evidence. We identified a technical flaw in the notice and the Crown conceded that the s.172 requirement has not been lawfully made in the circumstances. The case was formally deserted at Edinburgh Justice of the Peace Court.
