Our client had allowed her partner to drive her car on the understanding, and indeed condition, that he had the necessary insurance cover in place. It later transpired that the insurance policy had been cancelled due to a failure to renew. Our client’s plea of not guilty was accepted by the Crown on the basis that the causation / permission element  of the offence was conditional upon the appropriate insurance cover being held and therefore the statutory offence could not be established in evidence.
