Our client - a doctor - was accused of driving dangerously by failing to give way at a junction and causing another vehicle to take evasive action in order to avoid a collision. The minimum penalty if he was convicted was a driving ban of 1 year and an order to resit the extended driving test. Clearly, this was a serious situation. We investigated the case thoroughly and discovered that the road markings at the give way in question were particularly faint and could have been easily missed by any motorist. Having successfully persuaded the Procurator Fiscal that the standard of driving was merely careless we addressed the Court in mitigation. When we finished our plea in mitigation Sheriff was so appalled that the case had gotten so far he admonished our client and endorsed his licence with 3 penalty points - the minimum prescribed by statute. Our client was understandably very relieved and delighted.
