Dangerous Driving 123mph In A 40mph Limit

Our aim in dealing with this dangerous driving charge was, quite simply, to try to prevent our client from receiving a custodial sentence.  It was alleged that he had been racing another car and, in the process, drove at 123mph in a 40mph limit.

Clearly, there was no question that the driving was dangerous, the matter at issue simply being what disposal the Sheriff was persuaded to choose.  Following the Crown’s acceptance that the reference to racing should be removed, and our representations on behalf of our client, the statutory minimum penalty of a 12 month disqualification was imposed.
