Having been charged initially with dangerous driving, our client was relieved to hear that we had persuaded the Procurator Fiscal to accept that his driving had been careless

Due to delays caused primarily by the coronavirus pandemic a lot of time passed between the initial instruction and resolution of the case. Unfortunately, our client had managed to get 9 points (in England) during the course of this case. That made our job much more difficult. Having discussed matters there was no realistic prospect of successfully arguing that exceptional hardship would be suffered and our client wished simply to accept a totting-up ban. At a speed of 115mph the most likely outcome is normally an outright ban, however, we persuaded the Court to endorse our client's licence with penalty points instead and he was indeed disqualified under totting-up for the minimum 6-month period. At the end of this ban, our client's new licence will be clean, as all points are wiped out following a totting-up ban.
