Our client was accused of drink-driving in Falkrik and was prosecuted at Falkirk Sheriff Court. He had an additional charge of failing to disclose the details of the driver when asked to do so.

This was a sensitive and tricky case. Our client denied driving at all and therefore instructed that a plea of not guilty be instructed to the charge. 

We in-gathered all of the evidence in the case and at the trial contested the issue of identification of our client as the driver of the vehicle.

The Court was not satisfied that our client was the driver of the vehicle and accordingly he was found not guilty in respect of the drink-driving charge. He was however convicted of failing to disclose the identity of the actual driver and he had 3 penalty points added to his licence and a modest financial penalty.

This case demonstrates the difference between employing actual road traffic specialists and a general criminal lawyer. Well, you wouldn't go to your GP for brain surgery would you?
