Our client was originally charged with dangerous driving contrary to the Road Traffic Act 1988, Section 2 (as amended). 

The gravamen of the charge was that he had exceeded a 30mph speed limit by 100%. 

Our client denied this and was able to provide information pertaining to the actual speed of his vehicle at the time of the alleged incident, namely 50mph.

Armed with this information, we held a meeting with the Procurator Fiscal and managed to persuade a senior and very experienced Depute to reduce the charge to one of speeding, and also to downgrade it to the Justice of the Peace Court. Our Mr Simpson appeared at Edinburgh Justice of the Peace Court on 15th May 2024 and mitigated on behalf of our client resulting in 4 penalty points being endorsed upon his licence.

Our client's licence was retained.
