Our client was accused of falling asleep and ploughing into a worker at an area of roadworks following a night-shift. We were instructed in this case and appeared with our client at Court in 2018 where the case was slated to call before a Jury as a serious allegation of dangerous driving

We spent almost three years working on the defence of this matter. Following extensive investigations and several hours of negotiations, we finally managed to persuade the Procurator Fiscal that our client had not been asleep and, accordingly, the driving did not meet the test for a contravention of section 2 of the Road Traffic Act 1988.

The case called for sentence on 21st April 2021 and our Mr Simpson addressed the Court in mitigation. The Presiding Sheriff deemed the matter as being at the lower end of the spectrum and endorsed our client's licence with 4 penalty points and fined him £150.

This was an outstanding result.
