Our client was accused of causing serious injury by driving without due care and attention contrary to the Road Traffic Act 1988, Section 2C.

The minimum penalty upon conviction is a mandatory ban of 12 months.

In this case a pedestrian was unfortunately very seriously injured. However, our view from the outset was that our client was not to blame.

The case proceeded to trial at Kirkcaldy Sheriff Court on 17th April 2024. At the close of the Crown case, the Court accepted our legal submissions that there was 'no case to answer', and our client was acquitted of the charge.
