Our client was on his motorcycle and accused of driving dangerously on Maybury Road by undertaking several vehicles on his motorcycle, pulling out into lane 2 and overtaking an HGV whislt doing a ''wheelie''. Our view was that the undertaking was simply filtering through traffic, however, we had to accept that the overtaking wheelie was something that fell below (and almost far below) the required standard of driving. After terse negotiations, the Crown reluctantly accepted a plea of guilty to the statutory alternative of careless driving. The driving was poor and the Sheriff properly exercised his power of discretionary disqualification which we were able to restrict to only 2 months.
